EB-1A and EB-2 NIW for doctors, nurses and healthcare professionals
In short: healthcare professionals use the same green card routes as everyone else, but the evidence looks different. Clinician-researchers often fit the EB-1A or EB-2 NIW on the strength of publications, peer review and new protocols. Practicing clinicians often build an NIW around a proposed endeavor of national importance. Physicians and nurses also have special routes worth knowing about.
Who this covers
- Physicians and surgeons, in academic medicine and practice
- Biomedical and clinical researchers
- Nurses with advanced degrees, nurse practitioners and nurse researchers
- Pharmacists, physical therapists and allied health professionals
- Public health specialists, epidemiologists and health technology professionals
EB-1A: criteria that fit healthcare
- Original contributions: a new clinical protocol, surgical technique, device, care model or research finding adopted by other institutions or reflected in guidelines. See original contributions.
- Authorship: peer-reviewed research, case series, reviews and book chapters, with citation data in context.
- Judging: peer review for medical journals, grant review panels, abstract review for major conferences and board examination committees. See the judging criterion.
- Leading or critical role: leading a department, program, clinical trial or quality initiative at a distinguished hospital, academic medical center or research institute. See leading or critical role.
- Awards and memberships: competitive research awards and fellowships, and selective society fellowships where admission is based on achievement.
- Published material: coverage of your research or clinical work in medical news outlets and major media.
EB-2 NIW: often the natural fit
The NIW asks about your proposed endeavor and whether it has national importance. Healthcare lends itself to this: improving outcomes for a specific condition, expanding access to care, advancing a treatment, strengthening public health or training clinicians. You still need EB-2 eligibility (an advanced degree or exceptional ability) and evidence that you are well positioned to carry the work forward. See EB-1A vs EB-2 NIW and the EB-2 NIW guide.
Special routes to know about
- Physician national interest waiver. A separate NIW for physicians who agree to work full time in a designated health professional shortage area or a Veterans Affairs facility for a required period. It has its own rules and paperwork.
- Schedule A. Registered nurses and physical therapists can use an employer-sponsored route that skips the usual labor certification test.
- Licensing and training. Practicing medicine in the U.S. depends on state licensing, and foreign medical graduates have specific training and visa rules.
These routes are legal strategy decisions. A licensed immigration attorney should advise on which applies.
Evidence tips for healthcare
- Explain clinical impact in plain language: what changed for patients, and where
- Show adoption beyond your own institution: other hospitals, guidelines, training programs
- Use citation and peer-review data in context for your specialty
- Get letters from independent experts at other institutions, with specific facts
- Respect patient privacy: never include identifiable patient information

Frequently asked questions
Can a physician get an EB-2 NIW?
Yes. Physicians can use the general NIW standard, often based on research or a specialized clinical program of national importance. There is also a separate physician national interest waiver for doctors who agree to work full time in a designated shortage area or a Veterans Affairs facility for a set period. An immigration attorney can explain which fits.
Can nurses qualify for the EB-2 NIW or EB-1A?
Some can. Nurses with an advanced degree, such as a master's or doctorate in nursing, may qualify for EB-2, and an NIW depends on a proposed endeavor of national importance, for example in research, education, or improving care at scale. The EB-1A requires sustained acclaim. Registered nurses also have a separate employer-sponsored route under Schedule A.
Which EB-1A criteria fit clinical work?
Commonly original contributions (new protocols, procedures or devices adopted elsewhere), authorship of research articles, judging (peer review, grant panels), a leading or critical role at a distinguished hospital or research center, and sometimes high salary and awards.
