EB-1A and O-1A for founders and business leaders

In short: founders and executives qualify on what their businesses achieved and how the field recognized it: products and models others adopted, companies with a distinguished reputation, investment from respected backers, media coverage and judging roles. Your own U.S. company can file your O-1A, and you can file the EB-1A or EB-2 NIW yourself.

Criteria that fit business leaders

  • Original business contributions of major significance: a product, model or approach with documented adoption, revenue, growth or influence on your industry. See original contributions.
  • Leading or critical role: founder, CEO or executive at a company with a distinguished reputation, shown through investors, funding, customers, awards and press. See leading or critical role.
  • Published material about you: coverage of you and your company in business and trade media, with title, date and author.
  • Judging: startup competition and pitch juries, accelerator selection panels and industry award committees. See the judging criterion.
  • Awards: competitive business awards and selective programs, where the selection is based on excellence.
  • High salary or remuneration: possible for executives; founders paid mainly in equity should check whether this criterion fits. See high salary.

What makes a company "distinguished"

Reputation has to be proven, not assumed. Useful evidence:

  • Investment from well-known funds or angels, and the size of rounds
  • Notable customers and partnerships
  • Revenue, growth and market position
  • Selection by competitive accelerators or programs
  • Awards, rankings and press coverage in major outlets

Which pathway

  • O-1A: a common choice for founders who need U.S. work authorization now. Your own company or an agent can file. See the O-1 visa guide and O-1A vs EB-1A.
  • EB-1A: for founders and executives with sustained, documented acclaim. You can file it yourself.
  • EB-2 NIW: for founders with an advanced degree or exceptional ability and a venture of national importance. The case centers on your proposed endeavor and your ability to advance it. See EB-1A vs EB-2 NIW.
  • H-1B through your own company: an option for some H-1B holders building a company. See the H-1B founder guide.

Building the record while you build the company

Many founders grow their immigration profile and their company at the same time. The same milestones serve both: landing respected customers and investors, earning press for real results, speaking and judging in the ecosystem, and documenting growth. Keep records as you go: decks, funding documents, press, customer letters and metrics.

How BuildCaliber helps

We coach founders on both sides. For immigration, we map your record to the criteria and organize the evidence for independent partner attorneys. For the business, our startup coaching covers go-to-market, sales, business development and expansion, and H-1B founder coaching helps H-1B holders build a company as a second sponsor.

Frequently asked questions

Can a startup founder qualify for the EB-1A?

Yes. Founders qualify by documenting business contributions of major significance, a leading role at a company with a distinguished reputation, media coverage, judging (for example startup competitions) and other criteria. Funding, customers, revenue, press and recognition from respected investors all help show impact and reputation.

Can my own company file my O-1A?

Yes. A U.S. company you own can be the petitioner for your O-1A, as long as it is a real company that can employ you. A U.S. agent can also file. The EB-1A and EB-2 NIW do not need a company to file at all; you can file them yourself.

Is the EB-2 NIW good for entrepreneurs?

It can be. USCIS policy recognizes that entrepreneurs can show their proposed venture has national importance, for example through job creation, innovation or work in a critical field. Evidence such as investment, revenue, growth and a clear business plan helps show you are well positioned to advance it.
