O-1A vs EB-1A: differences, overlap and when to do both
In short: the O-1A is a temporary work visa that a U.S. employer, agent or your own company files for you. The EB-1A is a green card you can file for yourself. Both ask you to prove extraordinary ability with at least three criteria, and the evidence overlaps heavily. Many professionals get the O-1A first, keep building their record while working in the U.S., and then file the EB-1A.
Side by side
- What you get: O-1A is a nonimmigrant work visa, up to three years at first and extendable a year at a time. EB-1A leads to permanent residence.
- Who files: O-1A needs a U.S. employer, a U.S. agent or a U.S. company you own. EB-1A can be filed by you.
- Criteria: O-1A has eight criteria, EB-1A has ten. You need at least three in each (or a major internationally recognized award).
- Standard: both talk about being among the small percentage at the very top of the field. The EB-1A adds a stronger emphasis on sustained national or international acclaim, reviewed in a final merits step.
- Job requirement: the O-1A is tied to specific work, set out in a contract or itinerary. The EB-1A only needs you to show that you will continue working in your field in the United States.
- Cap or lottery: neither has a lottery. The O-1A has no annual cap. The EB-1A uses EB-1 visa numbers, which can have a wait for some countries of birth.
- Advisory opinion: the O-1A normally needs a written consultation from a peer group, labor organization or management organization in your field. The EB-1A does not.
The criteria compared
The eight O-1A criteria closely mirror eight of the ten EB-1A criteria:
| Criterion | O-1A | EB-1A |
|---|---|---|
| Nationally or internationally recognized prizes or awards | Yes | Yes |
| Membership in associations requiring outstanding achievement | Yes | Yes |
Published material about you in major media or trade publications | Yes | Yes |
| Judging the work of others | Yes | Yes |
| Original contributions of major significance | Yes | Yes |
| Authorship of scholarly articles | Yes | Yes |
Leading, critical or essential role for distinguished organizations | Yes | Yes |
| High salary or remuneration | Yes, past or future | Yes, past |
| Display at artistic exhibitions | No | Yes |
| Commercial success in the performing arts | No | Yes |
One useful difference: the O-1A salary criterion can rely on a salary you will command, shown by a contract or other reliable evidence. The EB-1A criterion looks at what you have commanded. Read our high salary guide for how pay is compared.
Why many people do O-1A first
- Earlier fit. A record that is strong but still building may be enough for the O-1A before it is enough for the EB-1A.
- Speed and flexibility. No lottery, no cap, and premium processing is available.
- Time to build. While working in the U.S. on an O-1A, you can keep adding the evidence the EB-1A needs: more judging, wider adoption of your contributions, media coverage and a growing critical role.
- Reuse. The O-1A file becomes the starting point for the EB-1A. Most documents, data and expert relationships carry over.
When to go straight to EB-1A
- Your record already shows sustained acclaim across several criteria.
- You do not have, or do not want, a U.S. employer or agent to file an O-1A.
- You are already in the U.S. on another status and mainly need the green card.
Some people file both: an O-1A for work authorization now and an EB-1A for permanent residence. An attorney can advise on whether that makes sense for you.
How BuildCaliber helps
We map your record to both sets of criteria, show which pathway is realistic now, and build one evidence plan that serves both. Read the full O-1 visa guide and EB-1A guide, or compare the EB-1A with the EB-2 NIW.
Frequently asked questions
Is the O-1A easier to get than the EB-1A?
Often, in practice. Both use the idea of being among the small percentage at the top of the field, and both need at least three criteria. But the EB-1A is a permanent benefit that asks for sustained acclaim, while the O-1A is a temporary visa, so many professionals qualify for the O-1A earlier in their career. Results depend on the evidence.
Does an O-1A approval mean my EB-1A will be approved?
No. They are separate petitions decided separately, and the EB-1A is generally reviewed more strictly. An O-1A approval shows your evidence was strong enough for that visa, and much of the same evidence can be reused, but it does not decide the EB-1A.
Can I file for the O-1A myself?
No. A U.S. employer, a U.S. agent or a U.S. company you own must file the O-1A petition for you. The EB-1A is different: you can file it for yourself.
